Machloket: How Halacha Is Decided
Lesson 120 · מַחֲלוֹקֶת
Halacha isn\'t a fixed code, it\'s a 2000-year argument. Tannaim disagree, Amoraim disagree, medieval poskim disagree, modern poskim still disagree. The Talmud preserves losing opinions on purpose. There are rules for resolving disputes (Halacha follows X), and there are entire categories where the dispute remains active. Knowing the major machlokot lets you navigate Jewish religious life, and gives you the vocabulary for legal reasoning in modern Israeli courts, which import many of these concepts.
Cultural note, Machloket (מַחֲלוֹקֶת) in modern Hebrew means "dispute" in any context, political, legal, scientific. Jewish tradition distinguishes "machloket l\'shem shamayim" (for the sake of heaven, productive) vs "she-lo l\'shem shamayim" (not for heaven, destructive). Pirkei Avot 5:17 names Hillel-Shamai as the model of the first, Korach as the second.

Hillel & Shamai on a Convert: Talmud Shabbat 31a
The most-quoted Talmud story illustrating Hillel and Shamai\'s opposite approaches. A non-Jew comes wanting to convert "while standing on one foot." Shamai pushes him away with a builder\'s ruler; Hillel teaches him the entire Torah in one sentence.
Pirkei Avot 5:17: Productive vs Destructive Disputes
The classic distinction. Hillel-Shamai is held up as the productive ideal, they argued for centuries but married each other\'s children and remained friends.
